Private access for approved buyers

WarmedUpp.com Terms of Service

Version TOS-2026-09-24 · Effective September 24, 2026

WarmedUpp.com is operated by Peanut Butter Marketing LLC, a Florida limited liability company, 433 Plaza Real, Boca Raton FL 33432; mailing address 11426 NW 81st Pl, Parkland FL 33076 ("we" or "us"). Contact: support@warmedupp.com. These terms cover use of our website and business-financing lead marketplace.

1. Agreement and scope

You accept these terms when you expressly agree to them as part of a buyer application or another site process that presents them for acceptance. If acting for a business, you represent that you can bind it. Buyer accounts are for adults acting for business purposes. Do not submit a consumer-purpose financing application through the marketplace.

The Buyer Agreement at /buyer-agreement governs eligibility, lead use, purchasing, wallet credit and returns, and controls over these terms on those subjects. The Privacy Policy at /privacy describes information handling. A merchant can submit a privacy or opt-out request without accepting a buyer contract or opening an account.

2. Service and accounts

We provide a marketplace for prepared leads relating to business financing. We may review buyer applications and restrict which purchases an approved buyer can make. Applying does not guarantee approval, exclusive access, inventory or any financing outcome.

Account details must be accurate. Each buyer account has one login. Keep credentials private, use two-factor authentication if you turn it on, and report suspected unauthorised access promptly. You are responsible for activity you authorise and for your failure to take reasonable measures to protect your account; this does not make you responsible for a security failure attributable to us.

We may change site features and temporarily interrupt service for maintenance, security or technical problems. We will address a charge without purchased access and accrued return claims under the Buyer Agreement. Changes to features do not silently change completed purchase terms.

3. Acceptable use and content

Do not circumvent access controls, test systems without authorisation, introduce malicious code, interfere with service, scrape restricted information, impersonate others, or submit unlawful or misleading content. Do not reidentify merchant previews, collect leads for resale, or bypass a purchase cap or account restriction.

You retain rights you hold in materials you submit. You grant us permission to host, copy, review and transmit those materials only as reasonably needed to provide the service, investigate issues, maintain security and records, and comply with law, as described in the Privacy Policy. This is not permission to sell your application or return evidence for unrelated marketing. Submit only information you are authorised to provide; minimise unrelated personal information and do not upload unlawfully recorded calls.

The website's design, software and original content belong to us or our licensors. We grant a limited permission to use the site for its intended purposes. Merchant information remains subject to privacy rights, source restrictions and the Buyer Agreement. A purchase is not an ownership transfer of personal information.

4. Third parties and financing decisions

The service may use payment, hosting, security and communication providers. Their separate services may carry their own terms and privacy notices. A link does not endorse another business or its offer.

Buyers independently decide whether to offer financing and on what terms. We do not guarantee approval, rates, revenue, merchant responsiveness or buyer conduct. A lead purchase does not create a partnership, employment, fiduciary relationship or authority to speak for another party. It does not itself authorise a consumer credit inquiry. Nothing in this paragraph changes a regulatory duty that applies to our actual activities.

5. Warranties and responsibility

We will provide the express purchase and return commitments in the Buyer Agreement. Subject to those commitments and mandatory law, the service is provided as available, without additional implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not promise uninterrupted service or that every merchant-provided statement is accurate. These qualifications do not excuse fraud, deliberate misstatements or obligations that cannot lawfully be excluded.

To the extent law permits, neither party is liable to the other for indirect or consequential losses, such as lost expected financing profits, arising from these terms. Each party's aggregate liability arising from the service is limited to the greater of $1,000 or the amounts paid for lead purchases during the 12 months before the event giving rise to the claim.

Those exclusions and limits do not apply to fraud, wilful misconduct, gross negligence, breach of confidentiality or personal-information security obligations, unauthorised use or disclosure of lead information, amounts properly due for purchases, return credits or repayment of unused deposited funds, or liability that cannot lawfully be limited. Money due under the Buyer Agreement is not reduced by the liability cap.

A buyer will reimburse us for third-party claims, reasonable defence costs and damages to the extent caused by that buyer's unlawful merchant contact, unauthorised disclosure or material breach of the Buyer Agreement. This does not cover our own fault. We must give prompt notice, permit reasonable participation in the defence, and obtain the buyer's consent before a settlement imposes an admission or non-monetary obligation on it. Consent may not be unreasonably withheld.

6. Restrictions and termination

We may investigate violations and restrict or end access when reasonably needed to protect the service or others, comply with law, or address a material breach. We will provide notice and an opportunity to respond where practicable. You may request account closure at support@warmedupp.com. Wallet settlement, accrued claims and treatment of purchased information follow the Buyer Agreement. We retain only records supported by the purposes and exceptions in the Privacy Policy.

7. Disputes and general provisions

Please first contact support@warmedupp.com with enough detail for us to investigate a dispute. Informal discussion is encouraged and does not prevent urgent relief, a regulatory complaint, or filing before a deadline.

Subject to mandatory protections, the laws of the State of Florida, without its conflict-of-laws rules, govern these terms. Courts with jurisdiction in Palm Beach County, Florida, hear disputes, except where applicable law requires another forum. This version does not require arbitration or waive class proceedings or jury trial.

If a provision is unenforceable, the remainder applies to the extent it can operate consistently with law and the agreement's purpose. A failure to enforce a provision is not a waiver. You may not transfer your account or access rights without our written consent. We may assign this agreement in a bona fide business reorganization or sale if the successor assumes our obligations and respects applicable information-use restrictions. This does not expand permissions to use personal information.

8. Notices and updates

We may send account, security and purchase notices to your registered email or through the site. Keep your contact information current. Optional marketing choices are separate from necessary service communications and agreement acceptance.

We will identify each version and its effective date. Material contractual changes require renewed acceptance before the affected service is used. A completed purchase retains its agreed price and return rights. Publishing an update does not itself grant new permissions to use previously collected personal information. The Buyer Agreement and these terms form the agreement for marketplace use, together with any separately signed written agreement that expressly identifies what it changes.
